Terms of Service
These terms govern your use of the Primen website, waitlist, and mobile application (together, the "Service"). The Service is currently operated by Indiginess ("Primen," "we," "us"). Primen Ltd is in the process of being incorporated and will take over operation of the Service once registered; we will tell you before this change takes effect. By using the Service you agree to these terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. Primen is designed primarily for users in the United Kingdom and European Economic Area. You are responsible for complying with any laws that apply to you locally.
2. The waitlist and founding pricing
Joining the Primen waitlist reserves a place for early access but does not guarantee the Service, any specific feature, or any particular launch date.
Any "founding member" pricing referenced on the website is an indicative offer for early users. The exact pricing, feature set, and availability of any paid plan will be confirmed at the point you are invited to subscribe. Once you subscribe at a founding-member price, we will honour that price for your subscription on the terms described at the time of purchase. Until you subscribe, pricing and plan details may change, and we will tell you about any material change before you are charged.
3. Medical disclaimer
Primen is a general wellness and health-information product. It is not a medical device, and it is not a substitute for professional medical advice, diagnosis, or treatment. Any assessments (including IIEF-5, qADAM, or similar questionnaires), scores, education modules, and content provided through the Service are for informational and educational purposes only. Scores generated by the Service are not a diagnosis and must not be used on their own to make medical decisions.
Always seek the advice of your GP or another qualified health provider with any questions you have about a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the Service.
If you are in crisis, contact the Samaritans on 116 123, call NHS 111, or dial 999 in an emergency.
4. Accounts
When account creation becomes available, you are responsible for the accuracy of the information you provide and for keeping your credentials confidential. Notify us immediately of any unauthorised access. We may suspend or terminate accounts that breach these terms.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose.
- Attempt to reverse engineer, scrape, or disrupt the Service or its infrastructure.
- Impersonate another person or misrepresent your affiliation with anyone.
- Upload malicious code or content that infringes a third party's rights.
- Use the Service to provide medical services to others.
6. Intellectual property
The Service, including its content, design, and trademarks, is owned by Indiginess (and, once incorporated, Primen Ltd) or its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial purposes. You retain ownership of any content you submit, and you grant us a licence to process it solely to operate and improve the Service.
7. Privacy
Our Privacy Policy explains how we handle your personal data, including special category health data. It forms part of these terms.
8. Disclaimers
The Service is provided on an "as available" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free, and we do not guarantee any specific health, fitness, or wellbeing outcome from using it.
Your consumer rights: nothing in these terms restricts or excludes any rights you have under the UK Consumer Rights Act 2015 or other mandatory consumer-protection law, including the right to have services performed with reasonable care and skill and the right to digital content of satisfactory quality.
9. Limitation of liability
To the fullest extent permitted by law, and subject to the consumer-rights carve-out below, Primen will not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of your non-excludable statutory rights as a consumer; or any other liability that cannot be excluded or limited under English law.
10. Termination
You can stop using the Service and remove yourself from the waitlist at any time. We may suspend or terminate access where you materially breach these terms or where required by law.
11. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email or in-app notice before they take effect. Continued use of the Service after the effective date means you accept the updated terms.
12. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these terms, except that if you are a consumer you may also bring proceedings in the courts of the country in which you reside.
